Terms of Service

1. Acceptance of Terms

By purchasing an eSIM from dracotel or using our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services.

2. Service Description

dracotel provides global eSIM connectivity services on a pay-as-you-go basis. Our service includes:

  • Provisioning and activation of eSIM profiles
  • Mobile data connectivity in supported countries
  • Balance management through your unique account URL
  • Optional auto top-up functionality

3. Pricing and Payments

3.1 eSIM Subscription

A $19 USD annual subscription fee is charged when you purchase your eSIM and renews each year. This subscription keeps your eSIM profile active and maintains your account.

Automatic renewal: If you have a credit card saved, your subscription will automatically renew each year. We will charge your saved card before your subscription expires. You can cancel auto-renewal at any time from your account page.

Bitcoin payments: If you paid with Bitcoin, your subscription will not auto-renew. We will notify you via your account page (and email if provided) before your subscription expires so you can manually renew.

Expiration: If your subscription expires and is not renewed within 30 days, your eSIM profile may be deactivated. Any remaining data balance will be preserved for 90 days and can be recovered by renewing your subscription.

Price changes: We reserve the right to change the subscription price at any time. If we change the price, we will notify you at least 30 days before your next renewal date. You may cancel your subscription if you do not agree to the new price.

3.2 Data Balance

You purchase data credit in advance. Data is charged at wholesale rates plus a 7.5% margin. Your balance never expires as long as your subscription is active. Unused balance is non-refundable.

3.3 Payment Methods

We accept Bitcoin (Lightning Network) and credit cards (via Stripe). Payment processing fees for card payments are displayed transparently at checkout and are non-refundable.

3.4 Saved Payment Methods

When you pay with a credit card and opt to save your payment method, we securely store your card information with our payment processor (Stripe) to enable future purchases and auto top-up functionality. We do not store your full card number on our servers.

By saving your payment method, you authorize us to charge your saved card for:

  • Manual top-ups you initiate from your account page
  • Automatic top-ups if you have enabled auto top-up

You can remove your saved payment method at any time from your account page, which will also disable auto top-up functionality.

3.5 Auto Top-up

If you enable auto top-up, you authorize dracotel to automatically charge your saved payment method when your account balance falls below your specified threshold. Specifically:

  • Authorization: You agree that we may initiate charges to your saved payment method without requiring additional approval for each transaction
  • Timing: Charges occur automatically when your balance drops below your configured threshold (checked periodically as you use data)
  • Amount: Each auto top-up will charge the amount you specify in your settings (minimum $5 USD), plus any applicable processing fees
  • Cancellation: You may disable auto top-up at any time from your account page, effective immediately for future charges
  • Failed payments: If your saved payment method fails 3 consecutive times (e.g., expired card, insufficient funds), we will automatically disable auto top-up to prevent repeated failed charges. You can re-enable it after updating your payment method.
  • Frequency limits: To protect against excessive charges, auto top-ups are limited to once per hour regardless of usage patterns.

4. Account Management

Your eSIM is managed through a unique URL. You are responsible for:

  • Bookmarking and securely storing your unique account URL
  • Not sharing your account URL with unauthorized parties
  • Maintaining sufficient balance for your data usage

If you lose your account URL and did not provide a recovery email, we may not be able to help you recover access to your account.

5. Acceptable Use

You agree not to use our services to:

  • Violate any applicable laws or regulations
  • Transmit malware, spam, or malicious content
  • Engage in fraudulent activities
  • Interfere with or disrupt our network or services
  • Resell or redistribute our services without authorization
  • Use our services for illegal file sharing or piracy

We reserve the right to suspend or terminate your eSIM without refund if you violate these terms.

6. Service Availability

While we strive to provide reliable connectivity, we do not guarantee uninterrupted service. Coverage and speeds depend on local network operators and conditions. We are not liable for:

  • Network outages or degraded performance
  • Coverage gaps in certain areas
  • Compatibility issues with specific devices
  • Service interruptions due to maintenance

7. Device Compatibility

You are responsible for ensuring your device supports eSIM technology and is carrier-unlocked before purchase. We cannot provide refunds for purchases made on incompatible devices.

8. Privacy

We are committed to your privacy. We collect minimal data necessary to provide our services. Please review our Privacy Policy for details on how we handle your information.

9. Limitation of Liability

To the maximum extent permitted by law, POLK Automation LLC (trading as dracotel) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our services.

Our total liability for any claim arising from these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Termination

You may stop using our services at any time. We may suspend or terminate your eSIM if you:

  • Violate these Terms
  • Engage in fraudulent payment activity

Upon termination, any remaining balance is forfeited and non-refundable.

11. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email (if provided) or by posting a notice on our website. Continued use of our services after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Wyoming, United States, without regard to conflict of law principles. dracotel is a trading name of POLK Automation LLC.
